Deposit and Payment

The retainer must be paid in full at the time of booking.

Retainer secures the time and services of the Photographer for the sitting and is non-refundable or transferable in the event of cancellation, it being the agreed loss suffered by the photographer due to cancellation. Sittings that are postponed to a later date will retain the fee as long as the photographer can re-schedule for the new date and time.

Following payment of the retainer, the remaining balance of any fees due is to be paid the day before the date of the sitting.

No photographs will be delivered until all payments due have been paid in full. Payment for additional images and albums is to be made when they are ordered.

Cooperation 

The parties agreed to cheerful cooperation and communication for the best possible results within the definition of this agreement. This cheerful cooperation and communication hereby include all times before, during, and after Client's event/wedding. Clients understand Kayla Golden (Photographer) Keeps a busy schedule before and after Client's wedding including the project of other clients.

Harassment

Kayla Golden (Photographer) Will not tolerate any form of harassment from Clients, those associated with Clients, persons representing Clients, guests, vendors, and/or any other person present before, during, or after Clients event/wedding If Kayla Golden (Photographer) feel uncomfortable or Threatened due to verbal, physical, or sexual harassment of any kind at Client's Event/wedding Kayla Golden (Photographer) will discuss the situation with Clients and if the situation is not resolved Kayla Golden (Photographer) reserves the right to withdraw from photographing Clients event/wedding and will not be held liable for reimbursement of any monies paid.

Artistic Style

Clients acknowledge that Kayla Golden (Photographer) requires and retains discretion concerning the services to be provided {i.e. posing, lighting, camera choice, lens choice, ect.}. Clients acknowledge and are familiar with photographer's portfolio and stylistic choices yet recognize that the art form constantly evolves is artistic in nature and yet is different than past artistic work by photographer. In the creation of the final product for clients, Kayla Golden (Photographer) reserves the right to artistic choices that fall within the boundaries of agreed upon services and terms.

Image Selection Process & Editing

After the date of the Photo session/Event and completion of Event Day services, the photos created from the day are subject to a careful selection process by Kayla Golden (Photographer) reserves the right to strategically choose the ideal photos to be edited and delivered to Clients. All culling and editing are under the complete control and authority of Kayla Golden (Photographer). 

does not guarantee a minimum number of photos to be delivered to Client.

Raw Photos

Under no circumstances will Kayla Golden (Photographer) allow the delivery of RAW photos to Clients.  All delivery of digital images will be in Jpeg format via an online gallery.

Photo/Data Archiving

Kayla Golden (Photographer) deletes all RAW photo files one month after the delivery of final edited jpeg files to Clients. Once the jpeg files are delivered to Clients via an online gallery. Clients are responsible for downloading and saving the delivered data in multiple places to ensure the safety of all edited photos.

Copyright 

All digital photo edits shall remain the exclusive copyright property of Kayla Golden (Photographer) to be used both publicly and privately; this copyright includes but is not limited to online use.

MODEL RELEASE

The Client & Subject grant to Kayla Golden (Photographer) the unrestricted right to use and publish photographs of the Client or in which the Client may be included.

​

IMAGE USE & COPYRIGHTS

 The photographer retains copyright to the photographs. Photographs shall be delivered to the Client via digital download. Client may not sell their images to any third party.

Clients may use them for personal use only.

Lost Items

Kayla Golden (Photographer) Is not responsible for items lost by the United States Postal Service / FedEx / UPS or invalid stamps and or addresses on contract form.

Location Access, Fees, Permits

If Clients choose to shoot at a location that charges for access and/or permit for photography. Client shall be responsible for all fees associated with shooting there, including but not limited to entrance fees and parking. Clients shall also be responsible for organizing access to the location and any permits required for doing so.

Creative Release

Kayla Golden (Photographer) Will document the event that transpired based upon prior communication between the client and Kayla Golden (Photographer).. 

Kayla Golden (Photographer) Will act in the best interest of Client's event and the preservation of Kayla Golden (Photographer) creative vision. In doing so, Kayla Golden (Photographer) Will try its best to capture moments as they transpire but cannot guarantee specific images or comprehensive coverage.

This Agreement incorporates the entire understanding of the parties.  Any modifications of this Agreement must be in writing and signed by both parties.  

This Agreement shall be governed by the laws of the State of Colorado
